1. Rental Agreement

The Customer represents that they are authorized to enter into this agreement and accepts full responsibility for the rented dumpster during the entire rental period.

2. Payment Terms Residential Customers

• Full payment is due prior to delivery.
• Iron Horse Waste Solutions reserves the right to refuse delivery until payment has been received.

Commercial Customers

• Payment terms are subject to prior written approval.
• Accounts not paid by the due date may be subject to late fees as permitted by Florida law.

Returned checks are subject to a $35 returned payment fee or the maximum amount permitted by Florida law.

3. Rental Period

The standard rental period is 7 days unless otherwise agreed in writing.
Additional rental days beyond the agreed rental period may be billed at $25per day.

4. Weight Allowance

Each rental includes the weight allowance specified on the invoice.

Any weight exceeding the included allowance will be billed at $95 per ton, rounded in accordance with certified landfill scale tickets.

Landfill scale tickets are considered final for determining disposal weight.

5. Prohibited Materials

Unless otherwise approved by Iron Horse Waste Solutions, the following materials are prohibited:

• Hazardous waste
• Paints, solvents, chemicals
• Oil, gasoline, fuel
• Batteries
• Asbestos-containing materials
• Medical waste
• Explosives
• Propane tanks
• Liquid waste
• Tires (unless approved)
• Refrigerators or appliances containing refrigerants (unless approved)
• Any material prohibited by federal, state, county, or landfill regulations

The Customer is responsible for all disposal costs, contamination fees, cleanup costs, fines, or penalties resulting from prohibited materials.

6. Dumpster Loading

Customer agrees that:

• Debris will not exceed the top rail of the dumpster.
• Materials will be evenly distributed.
• No materials shall hang over the sides or end of the container.
• Dumpster shall not exceed legal hauling weight limits.
• Iron Horse Waste Solutions may refuse pickup if the dumpster is overloaded or unsafe.

Any required offloading or redistribution of material will be billed to the Customer.

7. Placement of Dumpster

Customer shall provide adequate access for delivery and pickup. Customer is responsible for ensuring:

• Adequate overhead clearance.
• Adequate side clearance.
• Stable ground conditions.
• Legal placement of the dumpster.
• Required HOA or governmental permits.

Iron Horse Waste Solutions shall not be responsible for delays caused by inaccessible job sites.

8. Property Damage

Roll-off dumpsters and heavy trucks can cause damage to asphalt, concrete, pavers, lawns, landscaping, irrigation systems, underground utilities, sidewalks, curbs, and driveways due to their weight.

The Customer accepts responsibility for selecting the placement location. If the Customer requests placement on:

• Grass • Dirt

• Gravel • Shell

• Asphalt

• Decorative concrete

• Pavers

• Any surface other than reinforced concrete

Customer assumes all risk for resulting property damage. Iron Horse Waste Solutions shall not be liable for damage to:

• Grass
• Landscaping
• Trees
• Shrubs
• Sprinkler systems
• Underground utilities not visibly marked • Septic systems
• Wells
• Driveways
• Sidewalks

• Decorative surface

unless caused by gross negligence or willful misconduct.

9. Customer Responsibility for Dumpster

From delivery until pickup, the Customer is fully responsible for the dumpster.

Customer agrees to pay for repair or replacement resulting from:

• Fire damage
• Theft
• Vandalism
• Intentional damage
• Welding or torch cutting inside the dumpster • Concrete or debris frozen to the container

• Equipment impact
• Unauthorized relocation
• Damage caused by loading equipment

Customer shall immediately report any damage.

10. Blocked Dumpster

The Customer shall ensure the dumpster remains accessible during scheduled pickup. If pickup cannot be completed because the dumpster is blocked by:

• Vehicles
• Equipment
• Building materials • Locked gates
• Other obstructions

a $135 Blocked Pickup Fee will be charged.
Additional trip charges may apply if another pickup attempt is required.

11. Dry Run

If delivery or pickup cannot be completed due to site conditions beyond the control of Iron Horse Waste Solutions, a Dry Run Fee of $135may be charged.

Examples include:

• No access
• Locked gate
• Unsafe conditions
• Customer not ready
• Placement area obstructed

12. Same-Day Rush DeliveriesSame-day delivery requests received after 4:00 PM are subject to a $125 Rush Delivery Fee, subject to truck and driver availability.

Rush service is not guaranteed.

13. Relocation of Dumpster

Once placed, the dumpster shall not be moved by the Customer.
If relocation is requested after delivery, additional service charges will apply.

14. Weather and Unsafe Conditions

Iron Horse Waste Solutions may delay or refuse delivery or pickup due to:

• Flooding
• Hurricanes
• Severe weather
• Unsafe ground conditions • Unsafe jobsite conditions

No liability shall arise from delays beyond the company's reasonable control.

15. Indemnification

To the fullest extent permitted by law, the Customer agrees to defend, indemnify, and hold harmless Iron Horse Waste Solutions, LLC, its owners, employees, and agents from claims, damages, losses, fines, or expenses arising from the Customer's use or possession of the dumpster, except to the extent caused by Iron Horse Waste Solutions' gross negligence or willful misconduct.

16. Limitation of Liability

Iron Horse Waste Solutions shall not be liable for indirect, incidental, special, or consequential damages, including lost profits, project delays, or business interruption.

Iron Horse Waste Solutions' maximum liability shall not exceed the amount paid for the rental giving rise to the claim, except where prohibited by applicable law.

17. Collection Costs

Customer agrees to pay all reasonable costs incurred in collecting unpaid balances, including collection agency fees, court costs, and reasonable attorney's fees where permitted by law.

18. Governing Law

This Agreement shall be governed by the laws of the State of Florida.

Venue for any legal action shall lie in the appropriate state court located in Okaloosa County, Florida, unless otherwise required by law.

19. Entire Agreement

These Terms & Conditions, together with the rental invoice and any signed rental agreement, constitute the entire agreement between the parties and supersede any prior oral or written representations.

20. Governing Law

This Agreement shall be governed by the laws of the State of Florida.

Any legal action arising from this Agreement shall be brought in the appropriate court located in Okaloosa County, Florida, unless otherwise required by applicable law.

Customer Acknowledgment

By replying I AGREE, FOLLOWED WITH YOUR INITIALS,  you are electronically accepting these Terms, or authorizing delivery of the dumpster. The Customer acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions.
